Welcome to Bean To Cup.
These Terms & Conditions govern the use of the Bean To Cup website and the purchase of goods and services from Bean To Cup.
By placing an order with Bean To Cup, you agree to the terms applicable to that transaction.
Nothing in these Terms & Conditions is intended to exclude, restrict or waive any right that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”), or other applicable South African law.
1. About Bean To Cup
Bean Two Cup (Pty) Ltd, trading as Bean To Cup, is a South African retailer and supplier of coffee machines, coffee equipment, accessories, consumables and related products and services.
References in these Terms & Conditions to “Bean To Cup”, “we”, “us” or “our” refer to Bean Two Cup (Pty) Ltd trading as Bean To Cup.
If we want the Terms & Conditions fully complete, I’d also add the company registration number and registered/business address here. If you give me those, I’ll format the final Section 1 exactly for you.
2. Use of Our Website
You may use our website for lawful purposes.
You may not:
- Use the website for fraudulent or unlawful purposes.
- Attempt to gain unauthorised access to the website or its systems.
- Introduce malicious software or code.
- Interfere with the proper operation or security of the website.
- Use website content in a manner that infringes our or another party’s intellectual property rights.
We may update, suspend or modify parts of the website where reasonably necessary.

4. Product Information
We take reasonable steps to ensure that product descriptions, specifications, images and other information displayed on our website are accurate.
Product images may occasionally be illustrative. Minor differences in colour, packaging, accessories or appearance may occur due to manufacturing changes, screen displays or updated product versions.
Where a material specification is particularly important to your purchasing decision, you are welcome to confirm it with Bean To Cup before ordering.
If we identify a material error in a product listing after an order has been placed, we will contact you and deal with the matter in accordance with applicable law.
5. Pricing
Prices displayed on our website are stated in South African Rand (ZAR) and include VAT where applicable unless expressly indicated otherwise.
We endeavour to ensure that prices are accurate.
If an obvious or genuine pricing error occurs, Bean To Cup will address the error in accordance with applicable South African consumer legislation.
6. Placing an Order
Adding a product to your shopping cart does not reserve the product.
Before submitting an online order, customers are provided with an opportunity to review the products and information forming part of the transaction.
After an order has been submitted, Bean To Cup may send an electronic acknowledgement confirming receipt of the order.
An acknowledgement of receipt does not necessarily mean that an order has been finally accepted where payment, stock availability, fraud checks or other legitimate transaction requirements remain outstanding.
7. Order Acceptance
An order will generally be regarded as accepted once Bean To Cup has confirmed the order and payment has been successfully received or otherwise approved.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- Payment has failed or cannot be verified.
- Fraud or unauthorised payment is reasonably suspected.
- The product is unavailable.
- An obvious pricing or product-information error has occurred.
- We cannot lawfully fulfil the transaction.
- A customer has materially breached applicable transaction terms.
Where Bean To Cup cancels a paid order, any amount due to the customer will be refunded in accordance with applicable law.
8. Payment
Payment methods available at checkout may include card payments, electronic payment services, EFT, finance facilities or other payment options offered from time to time.
Certain payment methods are provided by independent third parties and may be subject to their own terms and approval requirements.
An order will not ordinarily be dispatched until the required payment has been successfully received or confirmed.
9. Ownership of Goods
Ownership of goods remains with Bean To Cup until payment for those goods has been received in full.
Risk and ownership will otherwise pass in accordance with applicable law and the circumstances of the transaction.
Nothing in this clause limits statutory consumer rights.
10. Stock Availability
All products are subject to availability.
Stock information displayed online is intended to assist customers but may occasionally differ from actual availability due to simultaneous orders, stock movements, supplier availability or system delays.
If a product becomes unavailable after an order has been placed, we will contact the customer and provide an appropriate solution, which may include:
- An estimated fulfilment date.
- An alternative product, with the customer’s agreement.
- A backorder, with the customer’s agreement.
- Cancellation and refund.
11. Special Orders and Lead Times
Certain products may be:
- Specially ordered.
- Imported on request.
- Procured from a supplier after purchase.
- Customised.
- Manufactured to order.
- Supplied in a particular colour, finish or configuration.
Estimated lead times are provided in good faith but may be affected by suppliers, manufacturers, international freight, customs, transport or other circumstances outside Bean To Cup’s reasonable control.
Where an order qualifies as a special or customised order, cancellation and return rights may differ as permitted by applicable law.

12. Delivery
Bean To Cup delivers products using our own delivery arrangements and/or independent courier and logistics providers.
Delivery times are estimates unless expressly agreed otherwise.
Customers are responsible for supplying accurate delivery information and ensuring that someone is reasonably available to receive the delivery where required.
Additional charges may apply to:
- Remote areas.
- Special delivery arrangements.
- Re-delivery following an unsuccessful delivery attributable to the customer.
- Express or priority services.
Where applicable legislation imposes particular delivery obligations, those obligations will apply.
13. Uncollected Orders
Where a customer elects to collect an order, we ask that the goods be collected within a reasonable period after the customer has been informed that the order is ready.
If goods remain uncollected for an extended period, Bean To Cup will make reasonable attempts to contact the customer.
Where legally permissible, reasonable storage, handling or other costs arising from prolonged failure to collect goods may apply after reasonable notice has been provided.
Where an order ultimately needs to be cancelled or otherwise dealt with, this will be handled in accordance with applicable law.
14. Returns, Exchanges and Refunds
Returns, exchanges and refunds are governed by our Refund & Returns Policy, available on our website.
That policy forms part of these Terms & Conditions.
Different rules may apply depending on whether the transaction concerns:
- A change of mind.
- An online cooling-off right.
- Used equipment.
- A defective product.
- An incorrectly supplied product.
- A custom or special order.
- A manufacturer warranty.
Nothing in these Terms & Conditions or our Refund & Returns Policy limits statutory rights that cannot legally be excluded.
15. Coffee Machines and Product Selection
Coffee machines differ considerably in their:
- Beverage capabilities.
- Capacity.
- Milk systems.
- Operating method.
- Cleaning requirements.
- Water requirements.
- Installation requirements.
- Performance characteristics.
Customers are encouraged to ask Bean To Cup for assistance before purchasing where they are uncertain whether a particular machine is suitable for their requirements.
A customer’s preference for another machine or dissatisfaction with a characteristic that operates according to specification does not, by itself, establish that the product is defective.
Return rights remain subject to our Refund & Returns Policy and applicable law.
16. Commercial Coffee Equipment
Commercial coffee machines and related equipment may require specific:
- Electrical supply.
- Plumbing.
- Drainage.
- Water pressure.
- Water filtration.
- Installation.
- Ventilation.
- Cleaning.
- Maintenance.
It is the customer’s responsibility to ensure that the installation location satisfies the manufacturer’s requirements unless Bean To Cup has expressly agreed to provide the applicable installation work.
Failure to comply with manufacturer installation or operating requirements may affect warranty coverage where legally permissible.
17. Installation
Where Bean To Cup provides or arranges installation, the scope of the installation will be agreed with the customer.
Unless expressly included in the quotation, installation does not necessarily include electrical, plumbing, cabinetry, building alterations or other third-party works required to prepare the premises.
Customers must disclose relevant site conditions that could reasonably affect installation.
18. Warranty
Products may carry warranties provided by the applicable manufacturer, importer or distributor.
Bean To Cup is a retailer and does not manufacture most products offered by us.
Where appropriate, Bean To Cup will assist customers in facilitating warranty claims with the relevant manufacturer, importer, distributor or authorised service centre.
Manufacturer warranties may contain requirements concerning:
- Household or commercial use.
- Installation.
- Water quality and filtration.
- Cleaning.
- Maintenance.
- Servicing.
- Electrical supply.
- Authorised repairs.
Manufacturer warranty terms operate in addition to statutory rights and cannot remove rights granted by applicable consumer legislation.

19. Warranty Process
Where a claim is dealt with under an additional manufacturer, importer or distributor warranty, the normal commercial warranty process may generally be:
Repair → Replace → Refund
The warranty provider may first determine whether the product can reasonably be repaired.
Where repair is not reasonably possible or appropriate, replacement may be considered.
Where repair or replacement is unsuccessful, unavailable or inappropriate, a refund or other remedy may be considered according to the applicable warranty.
This process does not override a remedy or choice expressly afforded to a consumer under the CPA or other applicable legislation.
20. Combo Deals and Bundles
Products sold as part of a combo or bundle may have different warranty terms.
The coffee machine may carry a manufacturer warranty different from warranties applicable to accessories or other products included in the bundle.
Consumables such as coffee beans are not covered by the coffee machine’s manufacturer warranty.
However, each product remains subject to any warranty or statutory protection applicable to that particular product.
21. Promotions
Promotional offers may be subject to:
- Specific promotional periods.
- Available stock.
- Purchase requirements.
- Product exclusions.
- Quantity limits.
- Other disclosed promotional conditions.
Unless expressly stated otherwise, promotions cannot necessarily be combined.
If a product supplied free or at a promotional price forms part of a qualifying bundle, our Refund & Returns Policy will apply if the main purchase is returned.
22. Website Availability
We take reasonable steps to maintain the availability and security of our website.
We cannot guarantee uninterrupted access at all times.
The website may occasionally be unavailable due to maintenance, technical failures, network problems or circumstances beyond our reasonable control.
23. Third-Party Services
Our website may integrate with or link to independent services such as:

Manufacturer names, logos, photographs and trademarks remain the property of their respective owners.
Website content may not be reproduced, distributed or commercially exploited without appropriate permission.
25. Reviews and User Content
Where customers submit reviews, photographs or other content to Bean To Cup, the content must not be:
- Unlawful.
- Fraudulent.
- Defamatory.
- Threatening.
- Infringing.
- Malicious.
- Intentionally misleading.
We may moderate or remove content where reasonably necessary and permitted by law.
26. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, Bean To Cup will not be responsible for losses arising solely from:
- Misuse of a product.
- Failure to follow manufacturer instructions.
- Unauthorised modifications or repairs.
- Incorrect installation not performed or approved by Bean To Cup.
- Circumstances outside our reasonable control.
Any limitation or exclusion of liability contained in these Terms & Conditions is subject to the CPA and other applicable South African legislation.
27. Privacy
Personal information is processed in accordance with our Privacy Policy and applicable South African privacy legislation.
Our Privacy Policy explains how Bean To Cup collects, uses, stores and shares personal information.
28. Events Beyond Our Control
Bean To Cup will not be responsible for a delay caused by circumstances genuinely beyond our reasonable control to the extent permitted by law.
Such circumstances may include:
- Natural disasters.
- Severe weather.
- Civil disruption.
- Transport interruptions.
- International shipping disruption.
- Government restrictions.
- Widespread network or infrastructure failures.
We will take reasonable steps to communicate material delays and fulfil our obligations as soon as reasonably possible.
29. Complaints and Disputes
If you have a concern about an order, product or service, please contact Bean To Cup first so that we have an opportunity to resolve the matter.
Nothing in these Terms prevents a consumer from exercising any right to approach an appropriate consumer body, regulator, ombud, tribunal or court where permitted by law.
30. Governing Law
These Terms & Conditions and transactions with Bean To Cup are governed by the laws of the Republic of South Africa.
Any dispute will be dealt with by a court, tribunal, regulator or other forum having lawful jurisdiction, subject to applicable law.
31. Changes to These Terms
Bean To Cup may update these Terms & Conditions from time to time.
Changes will apply prospectively from publication or such later date as may be specified.
Changes will not retrospectively remove rights or materially alter an already concluded transaction where doing so would be unlawful or unfair.
The current version will be published on our website.
32. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
